Welcome to CapybaraRush ("the Game"). These Terms of Service ("Terms") govern your use of the Game and related services provided by AJ Digital Technology Co., Ltd. ("we," "us," or "the Operator"). By downloading, installing, or using the Game, you agree to be bound by these Terms.
If you do not agree to any part of these Terms, please do not use CapybaraRush. Your continued use of the Game means that you have read, understood, and agreed to these Terms.
You must be at least 13 years old, or the minimum age required by the laws of your jurisdiction, to use the Game. If you are under the age of majority where you live, you may use the Game only with the consent and supervision of a parent or legal guardian who agrees to these Terms.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to download, install, and use CapybaraRush on devices you own or control, solely for personal and non-commercial entertainment purposes.
You agree not to misuse the Game or help anyone else do so. In particular, you must not:
The Game may offer virtual currency, virtual items, or other digital content. These items are licensed to you, not sold, and have no real-world monetary value. Purchases are processed by the applicable platform provider and are subject to that provider's terms and refund policies.
Except where required by applicable law, virtual items are non-transferable, non-refundable, and may not be exchanged for cash or other value outside the Game.
CapybaraRush may include third-party advertising, analytics, payment, or social services. Those services are governed by their own terms and privacy policies. We are not responsible for third-party content, services, or practices, and your dealings with third parties are solely between you and them.
All rights, title, and interest in CapybaraRush, including its software, game mechanics, artwork, characters, music, text, graphics, logos, and other materials, are owned by us or our licensors and are protected by applicable intellectual property laws.
CapybaraRush and related marks are our trademarks or those of our licensors. You may not use them without prior written permission.
Your privacy is important to us. Our collection, use, and sharing of personal information are described in the CapybaraRush Privacy Policy, which is incorporated into these Terms by reference.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE GAME IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
We do not guarantee that the Game will always be available, uninterrupted, secure, error-free, or free from harmful components, or that all defects will be corrected.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF OR INABILITY TO USE THE GAME.
Our total liability for any claim related to the Game will not exceed the greater of the amount you paid us for the Game in the preceding 12 months or USD 100, unless applicable law requires otherwise.
We may suspend or terminate your access to the Game if we reasonably believe that you have violated these Terms, created risk or legal exposure for us or others, or interfered with the operation of the Game. Upon termination, your license to use the Game ends immediately.
We may modify, suspend, or discontinue any part of the Game at any time. We may also update these Terms. If we make material changes, we will provide notice through the Game, this page, or another reasonable method. Continued use after the effective date of updated Terms constitutes acceptance.
These Terms are governed by the laws of Thailand, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Game will be resolved by the competent courts or other legally available dispute-resolution process in Thailand, unless applicable law requires otherwise.
These Terms, together with the Privacy Policy and any additional terms presented within the Game, form the entire agreement between you and us concerning CapybaraRush and supersede prior agreements or communications about the Game.
